Abstract


The dominance of fossil energy use in the midst of abundant renewable energy potential in Indonesia is the basis for looking at the existence of State’s Rights of Control (SRC) in the energy sector. This research aims to elaborate on the concept of SRC and its correlation to the use of renewable energy in Indonesia. This research was studied with a normative legal approach. The results show that SRC not only gives authority to the government, but also gives responsibility so that the utilization of natural resources is oriented towards the interests and prosperity of the community. The dominance of the use of fossil energy actually puts people and the environment in a threatened condition. Therefore, the selection of renewable energy in the primary energy mix is the responsibility of the government as part of SRC. to encourage the use of renewable energy in Indonesia, strengthening the concept of SRC is needed in every regulation and policy on the utilization of natural resources in the energy sector.

Author Biographies

Riswandha Imawan, Faculty of Law, Gadjah Mada University, Yogyakarta, Indonesia

Riswandha Imawan was born and raised in Kabupaten Sampang, East Java. He completed his primary to upper secondary education in Kabupaten Sampang. Subsequently, Riswandha continued his studies at the Islamic University of Malang, graduating with a Bachelor's degree in Law in 2021. Currently, Riswandha is pursuing his studies in the Master's Program of Law at Gadjah Mada University, Yogyakarta. Throughout his academic journey, he has contributed through his writings to several law journals focusing on agrarian law, environmental law, and human rights. In 2023, one of his research projects was funded by the Research and Publication Unit of the Faculty of Law, Gadjah Mada University, under the Student Research Grant Program.

Al Yasir, Faculty of Law, Gadjah Mada University, Yogyakarta, Indonesia

Al Yasir is a student at the Faculty of Law, Gadjah Mada University, with a keen interest in the study of constitutional law. He completed his undergraduate studies in Law at the State Islamic University Sultan Syarif Kasim Riau. Currently, he is pursuing a Master's degree in Law at the Master of Law Program, Faculty of Law, Gadjah Mada University. In addition to being a master's student, he is actively involved as a volunteer at the Center for Democracy, Constitution, and Human Rights Studies (PANDEKHA), Faculty of Law, UGM. In the field of research, in 2023, he was involved in the Student Research Grant Program by the Research and Publication Unit (URP) of the Faculty of Law, UGM. He is also engaged in various national and international conferences on constitutional law.
