چکیده

شورای نگهبان تاسیسی مستقل از قوای سه‌گانه در نظام حقوق اساسی ایران می‌باشد. با اینکه قانون‌گذاری ازجمله اَعمال ذاتی قوه مقننه بوده و مبتنی بر اصول و مبانی متعدد در پیکره دانش حقوق عمومی، دیگر نهادها فاقد این صلاحیت هستند اما باتوجه به متعدد بودن هنجارهای حقوقی، تفصیلی بودن مراتبِ امرِ تقنینی و بنا بر آنچه در واقعیت نظم حقوقی تحقق مییابد و گاه مقتضی اِعمال وظایف و اختیارات قانونی شورای نگهبان است، بخصوص در مقوله نظارت بر انتخابات که امری همه‌جانبه بوده و شورای نگهبان در آن به‌مثابه یک اداره نقش‌آفرینی می‌کند، تصور نحوی تقنین در قالب هنجاری حقوقی برای شورای نگهبان دور از نظر و عمل نمی‌باشد. این نوشتار با روش توصیفی تحلیلی و مبتنی بر منابع معتبر، با نگاهی به قواعد حقوقی و قوانین موجود در نظام حقوقی ایران، درصدد پاسخ به این سؤال است که دامنه و برد قانون-گذاری(درمعنای عام) و مقرره‌گذاری(درمعنای خاص) توسط شورای نگهبان چگونه است؟ تا اگر چنین صلاحیتی برای شورای نگهبان وجود دارد، به‌وضوح و تمایز درآمده و ضوابط و شرایط آن تدقیق و تعیین گردد. در انتها ضمن بررسی وجهه‌نظر‌های شکل‌گرفته پیرامون ماهیت حقوقی مصوبه انتخاباتی شورا، مبتنی بر مبانی نظری به‌دست آمده در پژوهش، مصوبه انتخاباتی شورای نگهبان ارزیابی می‌گردد.

چکیده [English]

The Guardian Council is an independent establishment in Iran's constitutional law system. Although legislation is one of the inherent acts of the legislature and based on several principles in public law, other institutions do not have this competence, but due to the multitude of legal norms, the detailed level of the legislative matter and according reality, and sometimes it is necessary to exercise the legal duties of the Guardian Council, especially in the elections, which is an all-encompassing matter and the Guardian Council plays a role in it as an office, a kind of idea of legislation in disguise. The legal norm for the Guardian Council is not far from thought and practice. With a descriptive method and based on reliable sources, looking at the legal rules and existing laws in Iran's legal system, this article tries to answer the question, what is the scope of legislation by the Guardian Council? if there is such a competence for the Guardian Council, should be clarified and its criteria and conditions should be determined. In the end, based on the theoretical foundations obtained in the research, the Guardian Council's electoral resolution is analyzed evaluated.
