摘要
海峡两岸立法语言都常用列举式，大陆《刑法》最常用且典型的列举式是“的” 字句式，台湾地区《刑法》最常用且典型的列举式是 “者” 字句式。大陆《刑法》“的” 字句式的列举项是 “的” 字结构，台湾地区《刑法》“者” 字句式的列举项是 “者” 字结构。“的” 字句式脱胎于 “者” 字句式。立法语言中的 “者” 字句式来自黄遵宪对日本《旧刑法》的翻译。
Abstract
Enumeration is commonly used in the cross-strait legislative discourse. The enumerated syntactic structure with de is the most commonly used and the most typical in the mainland criminal law, whereas the one with zhe is in the Taiwan criminal law. The de structure originated from the zhe structure. And the syntactic structure with zhe in Taiwan’s legislative discourse originated from Huang Zunxian’s translation of the Japanese Old Criminal Code.
