“Sherwin-Williams and two other former makers of lead-based paint do not have to pay punitive damages, based on a jury finding their products harmed children, a Rhode Island judge ruled. Jurors decided, however, that Sherwin- Williams, NL Industries and Millennium Holdings must pay to remove the danger of peeling paint from homes. Judge Michael Silverstein in Providence ruled after a hearing that the paint companies” behaviour was not sufficiently willful and reckless to justify setting punitive damages. The judge will decide later whether the companies must remove the paint from homes or seal it to make it safe.
