我國自1993年底正式邁入聯合國世界衛生組織所稱的「高齡化社會」後,至此便急速地朝「高齡社會」發展,不久的未來我國將面臨「超高齡社會」的挑戰。有鑑於家庭型態的解構,加上人口結構、社會環境的變遷,致使失能人口急速增加,進而如何妥適回應長期照護之需,儼然成為整體社會亟待解決的課題。為能「健全長期照護服務體系」,政府已將長期照護服務法草案(以下簡稱草案)送至立法院審查,冀望能整合不同法律對於各類機構及人員之歧異規範,藉以「確保服務品質、保障接受長照服務者之權益」。鑑於草案係為實施長期照護保險而預作準備,為使彼此間得以順暢銜接,本文試從政策規劃的脈絡切入,據以審視草案之內容,並分從需要評估、人員與機構之管理以及接受長照服務者之權益保障面向,提出若干建議供立法酌參,冀能回應草案所欲實現之立法目的。
As time goes by, satisfaction of living, health care and security need would become the main issues of people. Under this circumstance, long- term care (LTC) issues are more and more important. In response to this trend, the Department of Health (DOH) is creating a LTC Service Network. To provide accessible, affordable and quality LTC services, a draft LTC Services bill was under legislative review in mid-2011. Involving of LTC insurance is also expected to be enacted in the near future. But, how should we increase the effectiveness and efficiency of LTC services and let people approach them easily? Both systems are necessity. This article attempts to observe whether the bill of LTC services focus on the Legislative purposes and try to give advices for improving the inadequacies of legislative, managing LTC- related resources, even enhancing the LTC services quality in the future.
