AUTONOMY OVER THE FEMALE BODY? THE (IR) RECOGNITION OF THE RIGHT TO LAUREADURA AS A REPRODUCTIVE RIGHT IN THE BRAZILIAN ORDER

The issues related to reproduction, despite being related to all individuals, fall on the feminine simply because most of this process occurs in the woman's body. Thus, due to a patriarchal heritage, centered on the figure of the man, the woman ends up becoming responsible for all tasks related to reproduction while the man does not bear any burden. In this way, the female figure becomes linked to the task of procreation, organization of the home, submission to the husband and education of the children, being excluded from social life. In this tuning fork, female reproductive autonomy is disregarded and sexuality is restricted to only a portion of individuals. After the industrialization period, women were given greater autonomy in the exercise of their sexuality due to the development of contraceptive methods such as the contraceptive pill, for example. This fact represents an important milestone in the reproductive and sexual choices of the female population and in this context, the sterilization procedure becomes an important individual self-determination tool for the realization of this sexual and reproductive autonomy. It is important to highlight that this procedure has, for a long time, been considered a crime of qualified bodily injury and has actually been regulated by law 9.263 / 96 that standardizes the surgical procedure for sterilization as an exercise in family planning. Methodologically, we opted for the use of deductive and historiographic means, also counting on the use of literature review in a systematic way
