Abstract

Corruption in the judiciary system has been considered by Albanian citizens and international organizations as deeply corrupt. In 2016 Albanian Parliament, supported by the EU and USA, adopted a judiciary reform to increase transparency, accountability, impartiality and citizens’ access to information. One way of preventing corruption and increasing citizens’ access to justice is by using information technology. This paper analyses the role of information and communication technology in preventing corruption in the Albanian judiciary system. The main research question is how and to what extent digitizing the judiciary contributes to preventing corruption in the judiciary system. The paper argues that the use of ICT in the judiciary system has been limited due to several factors, such as lack of legislation on the use of ICT in the judiciary system, absence of a unified automated case management system, lack of appropriate education or training of judiciary staff to use ICT and lack of reinvestments on ICT equipment in courts. The 2016 judicial reform, for the first time, emphasized the importance of digitizing the judiciary system in Albania. The paper concludes that digitizing the judiciary will increase integrity and prevent corruption in the judicial system.

Bojana Hajdini, Department of Law, Epoka University, Albania

Bojana Hajdini holds an LLM and PhD in Law from the Faculty of Law, University of Tirana. Dr.Hajdini has a wide range of academic and professional experiences. She is a member of the Department of Law at Epoka University and has been teaching at the Faculty of Law and other Institution of Higher Education in Albania. Besides academic engagement, Bojana worked as Head of the Legal Opponent Office at the Ministry of Justice (2004-2008); advisor on human rights issues near Prime Minister's Office (2010-2013), and as State Advocate representing Albanian State before High Court and Constitutional Court (2018-2020). She has also a range of experiences as a legal consultant in the private sector (2013-2018). Bojana has published in various national and international journals and her research interest relates to Public and Criminal Law.

Gentjan Skara, Department of Law, “Bedër” University College, Albania

Dr. Gentjan Skara hods a LLB from the University of Tirana (Albania); a MA in "European Studies" from Epoka University (Albania); an LLM for “South East European Law and European Integration” from the University of Graz; PhD in "EU Law and National Legal System program" from the University of Ferrara. Has been a visiting researcher at the Institute of Corporate and International Commercial Law, University of Graz (Austria), and at the Department of International Law, University of Ljubljana (Slovenia). From October 2012, has been a full-time member of the Department of Law at “Bedër” University College teaching International and EU law courses. During September 2021 until September 2022, Gentiattended a Post-PhD Program in "Law and Technology" at MICHR. Genti has recently (May 2022) published a book in a well-known publisher, Springer Nature, titled “Europeanization of Albanian Competition Law: the Case of Albania”. His research interest relates to EU Law; Competition law, harmonization of laws and the relations between law and technology.
