ABSTRACT

This chapter draws up the main aspects that should be covered in a reform of European Union (EU) company law and corporate governance to ensure that European companies become a part of the solution to this convergence of crises that we face with interlinked environmental, economic and social consequences. Article 11 of the Treaty on the Functioning of the European Union (TFEU) not only provide a legal basis for including environmental protection requirements in all policies and areas but also extents necessary to secure sustainable development. The chapter ensures that companies indeed do 'integrate social, environmental, ethical, human rights and consumer concerns into their business operations and core strategy'. It presents that reporting requirements are an important aspect of the tentative company law reform. The reform of business towards sustainability encompasses dealing with cross-border supply chain issues and cross-border groups of companies.
