ABSTRACT

Chapter 5 focuses on subjects of international, i.e., an entity capable of possessing international rights and duties and having the capacity to protect its rights by bringing international claims. It examines the evolving nature of international personality and discusses the current challenges as to who should be regarded as a subject of international law. It assesses the criteria for statehood under international law in the light of the development of jus cogens rules and human rights law. It explains the difference between full and partial international personality, and subjective and objective international personality. It discusses the matter as to whether non-governmental organisations and multinational corporations should be granted international personality.
