In accordance with Article 2 of Leisure Fishing Management and Promotion Act, Leisure Fishing Vessel Business refers to the business of taking fishermen on board a leisure fishing vessel and guiding them to a fishing place or allowing them to fish. Leisure fishing vessels are considered as a main means of marine leisure activities for anglers and around seven million people are enjoying leisure fishing annually. However, various types of leisure fishing vessel accidents have increasingly occurred due to an increase in the number of leisure fishing vessels operating at sea. This paper explores ways to promote the safety environment of the operation of leisure fishing vessels in order to prevent such marine accidents. To this end, this study looks at the actual operating conditions of leisure fishing vessels mainly in the port of Yeosu where there is heavy traffic of leisure fishing vessels. Moreover, major fishing vessel accidents have been analyzed so that alternative measures can be identified with respect to aspects of human elements including the working environment of crew and captains who are mainly safety supervisors on board leisure fishing vessels. This study also suggests a shift of paradigm for leisure fishing vessels’ regime. Firstly, minimum capacity and sea experience for the captain of a leisure fishing vessel need to be made in law for the enhancement of safety on board. Also ‘securing of captain break/rest time’ and ‘mandatory boarding of purser’ are suggested to enhance the safe working environment for both captains and crew of leisure fishing vessels. Secondly, the reformation of the present safety education system needs to be made to change irrationality involved in the curriculum of a current education system for leisure fishing vessels. The current safety education of crew of leisure fishing vessels are akin to the one for general fishing boats although more than 20 passengers go aboard a fishing vessel. Lastly, this paper offers the introduction of business suspension order as an additional penal sanction to the shipowner who is liable for infringement of safety regulations. More importantly, this article argues that leisure fisheries business needs to be developed to a higher value-added business through the advancement and enlargement of leisure fishing boats in order to overcome the limit of safety policies managing within the framework of an increase of the income of fisheries off-season.

낚시어선업은 낚시인을 어선에 승선시켜 낚시터로 안내하거나 그 어선에서 낚시를 할 수 있도록 하는 영업이다(낚시관리 및 육성법§2). 낚시어선은 주요 해양 레저활동 수단으로 정착되어 한해 약 7백만 명이 낚시를 즐기는 것으로 추산된다. 하지만 낚시인 구 증가에 따른 낚시어선 운항 증가로 다양한 형태의 낚시어선 해양사고가 발생하고 있다. 이에 본 논문은 낚시어선의 해양사고 저감을 위한 적절한 운항환경 개선 방안을 도출하고자 하였다. 먼저, 최근 3년간 낚시어선 해양사고 발생 현황을 일반어선과 비교 와 낚시어선 충돌사고를 중심으로 발생시간, 톤수 등 발생 요인을 분석 하였다. 낚시어 선 해양사고 사례분석을 통해 문제점을 도출하고자 해양안전심판원에서 발행한 돌고래 호의 재결서를 통해 사고원인 관계를 분석하였다. 낚시어선 안전환경을 분석 하고자 먼 저 낚시어선의 문제점과 개선방향을 분석한 선행 연구 사례를 분석하였으며, 낚시어선 등록 척수와 통항량이 잦은 전남 여수지역의 낚시어선을 대상으로 장비보유, 조업형 태, 선원구성 현황 등 운항 실태를 관찰하였다. 또한, 낚시어선 소유자와 선장을 대상 으로 직접인터뷰를 통해 낚시어선 안전관리의 문제점을 파악하였다. 낚시어선 현황 운 항 실태와 해양사고 사례 분석을 통해 낚시어선 고용선장의 근로환경 등 제도상 한계점을 도출하였다. 이 논문은 어한기 소득보전 정책의 일환으로 낚시어선을 등록·운영하도록 하는 정 책만으로는 안전관리에 한계가 있다고 보고 낚시어선 안전정책에 대한 패러다임의 대 전환을 주장하였다. 이 논문은 어한기 소득증대차원의 낚시어선 안전정책의 한계를 극 복하기 위하여 선진화·대형화를 통한 고부가가치산업으로 육성할 것을 주장하였다. 이 를 위해서 10톤 미만 톤수제한을 해제하고 낚시인 어렵면허제도를 신설할 것을 제안하 였다.
