규제개혁감사는 경제활동규제와 안전규제에 관한 감사로 유형을 나눌 수 있는데 대부분 경제활동규제에 대한 감사임을 확인할 수 있었다. 경제활동규제에 관한 감사는 대체로 규제개혁 관리체계 운영의 적정성, 규제 완화 또는 폐지의 적정성에 관한 것이다. 반면 안전규제에 관한 감사는 규제의 불충분에 관한 것이 주요 내용으로서 두 유형이 서로 상반되는 점이 있다. 감사를 실시하고 그 결과를 도출하기 위해서는 사안의 타당성 유무와 그 정도를 판단하는 기준이 서있어야 한다. 규제개혁감사 사례를 분석한 결과 경제활동규제에 관한 감사판단기준으로 규제개혁 추진체계의 효율성과 실질성, 규제개혁의 필요성, 신속성, 적법성, 실효성 등을 확인할 수 있었다. 안전규제에 관한 감사판단기준에는 규제의 충분성이 있었다.
정보통신기술과 같은 새로운 기술이 확산되고 이를 활용한 플랫폼경제 등의 신산업이 발전하면서 기존의 법제도와 마찰이 발생하고 있다. 최근에는 플랫폼 공유경제 서비스인 우버와 카카오 카풀, 타다 사례에서 기존 시장참여자, 신규 시장참여자, 플랫폼 노동자, 소비자 등이 심각한 갈등을 빚으며 사회적 논란이 되었다. 신산업분야에서 이러한 다양한 갈등을 조정하기 위해서는 여러 측면의 검토를 통해 규제개혁이 진행되어야 한다. 개별 규제개혁사항이 경제활동규제나 안전규제의 한 측면을 주로 가지고 있다면 감사판단이 상대적으로 쉬울 것이다. 그런데 안전규제에 관한 사회적 합의 수준이 높아지고 개인의 권리가 신장되면서 신산업에 관한 규제개혁이 경제활동규제와 안전규제의 측면은 물론 다양한 성격을 함께 가지게 되었다. 이에 따라 기존의 감사판단기준만으로 감사결과를 도출하기에는 일정한 한계가 있다. 그래서 신산업분야에 대한 규제개혁의 타당성을 판단하기 위해 추가적인 감사판단기준이 필요해졌다. 다양한 이해관계자의 측면에서 헌법적 검토를 하여 판단기준을 도출할 수 있다. 개별 감사판단기준으로는 우선 경제활동규제의 실효성과 안전규제의 충분성이 여전히 중요하게 자리매김할 것이다. 추가로 신산업의 신뢰성, 신규 시장참여자의 직업선택의 자유와 노동권 보장, 기존 시장참여자의 권리 보호, 소비자의 권리 보장 등을 고려할 수 있다.

The audit on economic activity regulation is generally about the adequacy of the operation of the regulatory reform management system and the adequacy of deregulation or abolition. On the other hand, the audit on safety regulation mainly focuses on insufficient regulation. As new technologies such as Information and Communication Technology spread and new industries such as Platform Economy using them develop, friction with the existing legal system is occurring. Recently, in the case of Uber, Kakao Carpool, and Tada, which are platform sharing economy services, existing market participants, new market participants, platform workers, and consumers caused serious conflicts and became a social controversy. In order to reconcile these various conflicts in the new industry, regulatory reform should proceed through a review of several aspects. As the level of social consensus on safety regulation has increased and individual rights have been expanded, regulatory reform for new industries has come to have various characteristics as well as economic activity regulation and safety regulation. Therefore, additional audit judgment standards were needed to judge the feasibility of regulatory reform in the new industry sector. Judgment standards can be derived by reviewing the constitution from the perspective of various stakeholders. The effectiveness of economic activity regulation and the sufficiency of safety regulation will still be important as individual audit judgment standards. In addition, the reliability of the new industry, the freedom of job choice and labor rights for new market participants, protection of the rights of existing market participants, and the protection of consumer rights can be considered.
