프랑스의 방문권에 관한 법 상황은 변화되어 왔으나, 방문권의 권리주체에 관계없이 공통적으로 논할 수 있는 법 개정의 기준은 점차적으로 子의 이익이나 子의 권리보호에 있었다. 즉 방문권이 인정된 초기에는 방문권을 방문하는 측의 권리로서만 구성되었으나, 최근의 방문권은 子의 권리이거나 방문권자와 子의 상호적 권리라는 입장이 지배적이다. 특히 이와 같은 변화는 1989년의 UN 아동권리협약 및 2000년 공포된 유럽연합 기본권 헌장이 큰 영향을 주었다고 할 수 있다. 유럽인권법원 또한 면접교섭권을 판단함에 있어 관련된 모든 사람들의 이익의 균형을 맞추어야 한다고 하면서도 실질적으로는 아동의 복리에 우위를 두고 있다. 아동의 복리는 사실상 가족 유대관계를 형성했던 사람과의 관계를 유지하는 것이 중요하다고 할 수 있으므로 특별한 사정이 없는 한 이들의 면접교섭권을 인정한다. 즉 유럽인권법원은 이를 기초로 하여 부모든 부모 이외의 자이든 일반적으로 가족 유대 관계를 지속하게 하는 것이 아동의 복리에 부합한 것으로 보며, 그 관계는 혈연과는 무관한 것으로 본다. 이러한 영향으로 프랑스를 비롯하여 유럽의 다수 국가가 점차적으로 면접교섭권자의 범위를 더 확대하고 있다.
우리민법이 최근 개정으로 직계존속에까지도 면접교섭권을 인정하는 예외규정을 두고 있으나 해석으로 그 범위를 넓히는 것은 차치하더라도 명문규정만을 놓고 본다면, 다른 나라에 비하여 협소하다. 장기간에 걸친 프랑스 내에서의 면접교섭권자의 범위와 관련한 개정을 통해 확인할 수 있는 것처럼, 면접교섭권자의 범주를 원칙적으로 좁히고 예외적으로 그 범주를 넓히기보다는 원칙적으로 그 범주를 넓히고 예외적으로 좁히는 방식이 자녀의 권리로서의 면접교섭권을 실질적으로 보장한다. 향후 우리민법의 개정시에 이러한 태도가 수용되기를 기대해 본다.
Although the provisions on the visitation rights have been changed under the French Civil Law, the standard for amendment of the law that can be discussed in common regardless of the subject of the right to visit was gradually in the interests of the child or the protection of the child’s rights. In other words, in the early days when the visitation rights was recognized in France, it consisted only of the right of the visitor, but in recent years, the position that the visitation rights is the right of the child or the mutual right of the right to visit and the child dominates. In particular, the European Court of Human Rights believes that continuing family ties irrespective of blood ties is suitable for the welfare of children, and due to this influence, France and many other European countries are gradually expanding the scope of the person who can exercise the visitation rights. With the recent revision of the Korean Civil Act, there are exceptions that allow for the visitation rights of grandparent, but apart from expanding the scope by interpretation, it is narrower than other countries in terms of prestigious regulations. As can be seen through a long-term amendment to the scope of the person who can exercise the visitation rights in France, the method of broadening the scope of the person who can exercise the visitation rights in principle and narrowing them to the exception substantially guarantees the visitation rights as a child’s right. I look forward to the acceptance of this attitude in future amendment of the Korean Civil Act.
