이 글은 기업의 비즈니스전략 차원에서 접근하는 전략적 특허경영관점에서 특 허이슈를 개념적으로 고찰함으로써 기업경영차원에서의 특허경영에 대한 체계적 인 접근을 시도하고 그 과정에서 발생할 수 있는 주요 이슈를 개념적으로 정리하 고자 하였다. 두 가지 사실 즉, 특허권의 발생과 강화로 기술력과 기술사용권한은 분리된다는 점과, 특허권의 강화와 혁신분업의 확산으로 제품시장과 기술시장의 분리가 확대된다는 점에 주목할 때, 전략적 특허경영의 구조는 네 가지 요소로 구 성될 수 있다. 첫째, 리스크관리(Risk Management)이다. 둘째, 자산관리 (Asset Management)이다. 이들 두 요소가 효과적으로 기능하기 위해서는 세 번째와 네 번째 요소가 필요하다. 셋째, 특허정보활용(Information intelligence)이다. 넷째, 특허경영의 인프라(infrastructure)가 사내에 구축되 어야 한다. 이러한 논의로부터, 제품시장 위주 및 기술력 위주의 사고방식으로부 터 기술사용권한인 특허에 기반한 사고로의 발상의 전환이 필요하고 비즈니스모 델의 유지와 확대를 위해서는 제품시장과 기술시장을 동시에 고려해야 한다는 점 을 알 수 있다. |

| 영문 초록정보 | This work tries to approach the patent management and analyze its issues from the perspective of business management. This work focuses on two stylized facts. First,there is separation between capability to use technology and the right to use technology due to the emergence and strengthening of patent rights. Second, there hasbeen enlarged separation between product market and technology market due to the strengthening of patent rights and the diffusion of innovative division of labor. Based on this phenomenon, the structure of strategic patent management can be summarized as four factors. The first one is risk management; the second one is asset management; the third one is information intelligence; the last one is infrastructure for patent management. From this discussion, we come to know that it is necessary to change way of thinking from focusing on product market and on capability to use technology to patent-based one and also to consider product market and technology market simultaneously to sustain and grow the business model. | |||
