Market mechanism is a new policy tool adapted by government on environment governing for pollution controlling. The United Nations Framework Convention on Climate Change required the ratified countries to reach their emission reduction targets and the Kyoto Protocol designed flexible mechanisms, including emission trading, for industrial country Parties to adjust their internal reduction cost but also achieve the commitments. The flexible mechanisms are designed to encourage the Parties complying their commitments and also raise their abilities and capacities. However, the government adopted the emission trading mechanism but not perform the cap yet, although the Air Pollution Controlling Act owns fragmentary regulations on emission trading system. Therefore, this article collect the emission trading regulations on the convention and protocol and also discuss the elements for designing emission trading market. Through analysing the regulations on the Convention and the legislation experiences on emission trading of foreign countries, they could be good examples for our government to design the proposal on controlling greenhouse gases and also the regulations on establishing domestic emission trading market.
