Ⅰ. 배경 및 목적
□ 지난 2016년 1월 제46회 다보스 포럼에서 제4차 산업혁명이 화두로 등장한 후,ICT, 인공지능기술의 발달로 산업, 사회구조의 지각변동이 일어나고 기존의 경제 개념을 뛰어넘는 신성장 산업 모델이 속속 등장하고 있음
□ 제4차 산업혁명은 IoT와 인공지능을 기반으로 사이버 세계와 물리적 세계가 네트워크로 연결돼 하나의 통합 시스템으로서 지능형 ‘사이버물리시스템’(cyber- physical system; CPS)을 구축함으로써 “모든 것이 연결되고 보다 지능적인 사회로의 진화”가 이루어질 것으로
Ⅰ. 배경 및 목적
□ 지난 2016년 1월 제46회 다보스 포럼에서 제4차 산업혁명이 화두로 등장한 후,ICT, 인공지능기술의 발달로 산업, 사회구조의 지각변동이 일어나고 기존의 경제 개념을 뛰어넘는 신성장 산업 모델이 속속 등장하고 있음
□ 제4차 산업혁명은 IoT와 인공지능을 기반으로 사이버 세계와 물리적 세계가 네트워크로 연결돼 하나의 통합 시스템으로서 지능형 ‘사이버물리시스템’(cyber- physical system; CPS)을 구축함으로써 “모든 것이 연결되고 보다 지능적인 사회로의 진화”가 이루어질 것으로 예측됨
□ 미국, 독일, 일본 등 선진국들은 제4차 산업혁명 시대에 선제적으로 대응하기 위하여 장기계획 수립과 투자를 추진하고 있음
□ 제4차 산업혁명의 한국 대응 전략은 ‘기술’과 ‘규제’라는 양대 축으로 구성될 것이고, 제4차 산업혁명 시대에는 국가 경쟁력을 선도해 나갈 신성장 전략을 체계적으로 추진하고, 이를 뒷받침하기 위하여 규제법제를 개선하는 것이 매우 중요함
□ 무엇보다도 제4차 산업혁명 시대에 신기술을 둘러싸고 갈등의 원인이 되는 이익 충돌 상황은 매우 다양하고, 문제되는 위험의 종류나 위험 발생의 가능성 등도 매우 상이하며, 기존의 규제가 기술혁신의 속도를 따라가지 못하여 혁신과 시장화를 지연시키거나(pacing problem) 혁신기술에 맞는 적정 규제수단에 대한 정보가 부족(lack of information)의 문제가 지속적으로 제기될 것임
□ 좀 더 회복력 있는 체제를 생산할 수 있는 규제와 법 제정의 생태계를 조성하는 것이 제4차 산업혁명 시대에 필요한 규제법제 전략일 것임
□ 이 연구는 이상의 문제 인식에 따라 제4차 산업혁명시대의 신성장분야 규제전략 및 규제법제를 체계적으로 분석하여 시사점을 도출하고, 제4차 산업혁명에 따른 규제체계 및 규제 거버넌스 개선방안을 제시하며, ICT 융・복합 산업 분야 규제체계 개선 방안을 마련하고, ICT 융・복합 산업 분야 규제 사례를 발굴하여 그 개선방안을 제시하는 것을 목적으로 함
Ⅱ. 주요 내용
□ 신성장분야 규제법제개선연구는 총 3개년(2017년-2019년)으로 계획된 것으로 제4차 산업혁명 시대의 신성장 동력 산업에 해당하는 ① ICT 융복합 산업 분야, ②스마트시티 산업・바이오 산업 분야, ③ 신소재・부품, 신에너지 산업 분야를 연구의 대상으로 함
□ 신성장분야 규제법제개선연구의 1년차 연구인 2017년도 연구는 성장분야 규제법제개선연구의 총론적 성격의 연구를 포함하면서 특히 ICT 융합 산업 분야를 중점 대상으로 삼음
□ 2017년도 신성장분야 규제법제개선(Ⅰ) 연구는 학제 간 및 산학연 간 융복합 연구로 기획된 것으로 다음의 표와 같이 총 4편으로 나누어 주제별로 연구 수행 주체를 달리 구성하고, 이 중 제1편과 제2편이 총론적 성격의 연구에 해당함
□ 제1편 “제4차 산업혁명시대의 신성장 전략 및 규제법제 분석”에서는 신성장분야 규제법제개선 연구의 필요성 및 목적을 밝히고, 제4차 산업혁명에 대한 대응에 박차를 가하고 있는 한국, 일본, 독일의 신성장 전략 및 규제법제를 분석하여 한국의 신성장 전략과 규제법제 개선을 위한 시사점을 제언함
○ 신성장 전략의 중요성과 한국의 역대 정부의 신성장 전략(ICT 신성장 전략을 포함함)을 분석하고, 신성장 전략 추진을 위한 법적 근거 및 법제적 문제점을 밝힌다. 또한 신성장분야 규제법제 현황을 분석하고, 규제법제 개선을 위한 대응 방안을 모색함
○ 일본의 신성장 전략과 규제법제를 제4장에서는 독일판 신성장 전략이라 할 수 있는 ‘인더스트리 4.0 전략’과 규제법제에 관해서 분석함
○ 일본과 독일은 우리나라와 경제구조가 유사하면서도 저성장 기조의 가속화・글로벌 경쟁심화 등에 따른 대내외 환경변화에 대응하여 국가경쟁력을 제고하기 위해서 제4차 산업혁명에 적극적으로 대응하고 있는 국가이므로 분석대상으로 선택함
□ 제2편 “제4차 산업혁명에 따른 규제체계 및 거버넌스의 개선 – 행정법이론을 중심으로 한 접근 -”에서는 제4차 산업혁명에 따른 신기술 개발과 적용에 있어 관련 입법, 행정행위, 행정지도, 행정조직 등 각각의 행정법적 이슈별로 검토하고,수직적 거버넌스에서 수평적 거버넌스로의 전환에 필요한 법제적 논의를 함
○ 제4차산업혁명 규제체제의 헌법적 기초를 살펴보고, 네거티브규제, 규제프리존・규제샌드박스, 비조치의견서, RegTech, 자율규제 등을 중심으로 제4차 산업혁명시대 규제법체계의 개선방안을 제시함
○ 법률유보주의・법규명령・행정규칙에 대한 재검토를 통해서 제4차 산업혁명 시대에 맞는 행정입법의 개선방안을 제시하고, 기존의 행정행위의 변형을 통한 규제 개선 가능성, 신고제도의 재검토와 활용가능성 등 제4차 산업혁명 시대에 맞는 행정행위 및 신고법제의 개선방안을 제시함
○ 규제계약, 기술혁신 관련 계약제도, 혁신친화적 계약방식 등을 중심으로 한 행정계약법의 개선방안을 제시하고, 공청회, 행정상 입법예고, 행정계획에 대한 절차적 통제 등 제4차 산업혁명 시대에 맞는 행정절차법의 개선방안을 제시함
○ 행정기관간 권한조정, 중앙정부와 지방자치단체간 권한 배분, 사인에 의한 행정임무의 수행 등을 중심으로 제4차 산업혁명 시대에 맞는 행정조직법의 개선방안을 제시함
○ 제4차 산업혁명시대의 개인정보 보호법제의 쟁점을 분석하여 개선방안을 제시하고 전자정부에서의 개인정보의 보호방안을 제시함
○ 행정법의 기본법률, 제4차 산업혁명 관련 기술법률, 제4차 산업혁명 관련 최근 발의안에 대한 검토를 통하여 관련법제의 개선방안을 제시함
□ 제3편 “ICT 융・복합 산업 분야 규제체계 개선 연구”에서는 신기술 분야에 적합한 규제개선 수단으로 「정보통신 진흥 및 융합 활성화 등에 관한 법률」에 도입된‘신속처리・임시허가제도’, 「산업융합 촉진법」에 도입된 ‘적합성 인증제도’를 중심으로 ICT 융・복합 산업 분야 규제체계 개선방안을 제시함
○ 미국 FDA의 ‘Innovation Pathway’와 국내 산업융합촉진법 상 ‘적합성 인증제도’를 중심으로 살펴봄
○ ICT 특별법 상 ‘신속처리·임시허가’ 제도에 대해 분석하고, 규제개선체계 개선방안과 제도 활성화를 위한 정책방안으로 구분하여 정책제언을 제시함
□ 제4편 “ICT 융・복합 산업 분야 규제 사례 연구”에서는 ‘AI(인공지능), 웨어러블기기, 자율주행자동차’ 등 ICT 융・복합 산업 분야의 규제 사례를 발굴하고, 합리적인 대안을 제시함
○ 국내 산업 분야별 ICT 융·복합 현황 및 문재인 정부 미래형 신산업 관련 공약 내용을 바탕으로 국내 산업별 ICT와의 융합이 이루어지고 있는 분야 중에서 기존 ICT 담당부처가 주관이 아닌 기존 부처의 업무 분장과 분야의 융·복합으로 희석화가 되는 분야 5가지(자율주행자동차, 의료산업, 금융 산업, 웨어러블 디바이스, 인공지능・콘텐츠 산업)를 선정하여 이 분야를 중심으로 ICT 융·복합 규제사례를 발굴하고, 개선방안을 제시함
□ 2017년도 신성장분야 규제법제개선(Ⅰ) 연구는 학제 간 및 산학연 간 융복합 연구를 위하여 과학기술・경제이론 및 실무 관련 전문가 개별 자문, 전문가회의・학술대회・컨퍼런스・워크숍 등을 개최하여 융복합 연구의 질적 완성도 제고, 연구경험 및 성과의 공유 확산을 도모함
Ⅲ. 기대효과
□ 신성장분야 혁신기술의 신속한 사업화・상용화 지원을 통한 글로벌 기술선진국 도약의 규제법적 기반 조성

□ Since the Fourth Industrial Revolution emerged as an issue at the 46th Davos Forum in January 2016, the development of ICT and artificial intelligence technology has brought about an upheaval in the industries and social structures, and models of new growth industries surpassing conventional economic concepts have been emerging one after another.
□ Through the Fourth Industrial Revolution, an intelligent “cyber-physical system (CPS)” will be established as an integrated system connecting cyber world and physical world via networks, based on IoT and artificial intelligence. The CPS is expected to enable “an evolution to a more intelligent society where all things are connected.”
□ To preemptively respond to the era of the Fourth Industrial Revolution, the United States, Germany, Japan, and other advanced countries have made long-term plans and investment.
□ Korea’s coping strategy for the Fourth Industrial Revolution will be composed of two axes: technology and regulation. Under the Fourth Industrial Revolution, it is critical to systematically implement new growth strategies to boost national competitiveness; and to improve regulatory legislation to support the implementation of such strategies.
□ Various risks will be posed by the Fourth Industrial Revolution. Different interests will conflict in many circumstances involving new technologies. Types of the risks will be many, with varying probability of each risk occurring. Among such risks are a pacing problem where existing regulations fail to keep up with technology innovation, resulting in the delay of innovation and commercialization; and lack of information about means to regulate innovative technology.
□ One strategy necessary for regulatory legislation in the Fourth Industrial Revolution will be to create an ecosystem of regulation and legislation, in which more resilient systems can be produced.
□ Based on the recognition of the problems mentioned above, this study aims: to draw implications by systematically analyzing regulatory strategies for new growth industries and regulatory legislation; to propose a scheme to improve the regulatory system and regulatory governance for the Fourth Industrial Revolution; to formulate a scheme to improve the regulatory system for the ICT convergence industry; and to present a scheme to improve regulations by searching out cases of regulations in the ICT convergence industry.
Ⅱ. Major Contents
□ Study for Improving Regulatory Legislation on New Growth Industries was planned as a three-year research project focussing on industries that will serve as the new growth engine in the era of Fourth Industrial Revolution. They include: (1) ICT convergence industry; (2) smart city industry and bio-industry; (3) new materials and components industry and new energy industry.
□ The 2017 study, the first-year phase of the Study for Improving Regulatory Legislation on New Growth Industries, includes an introduction to the Study for Improving Regulatory Legislation on New Growth Industries and is focused particularly on the ICT convergence industry.
□ The 2017 Study for Improving Regulatory Legislation on New Growth Industries(I) was planned as an interdisciplinary research project to be performed jointly by the industry, academia and research institutes; and is divided into four parts as outlined in the following table according to the entity responsible for performing the study on each theme, among which Parts 1 and 2 are introductory research.
□ Part 1 is entitled “Analysis on New Growth Strategies and Regulatory Legislation in the Era of the Fourth Industrial Revolution.” This part of the study clarifies the needs for and the purpose of the Study for Improving Regulatory Legislation on New Growth Industries; and proposes implications for improving the new growth strategy and regulatory regulation of the Republic of Korea by analyzing new growth strategies and regulatory regulation of Korea, Japan, and Germany accelerating their response to the Fourth Industrial Revolution.
○ With an emphasis on the importance of new growth strategies, this part of the study analyzes new growth strategies (including new growth strategies for ICT) of the former governments of Korea; and examines the legal basis for implementing new growth strategies and any legislative problems. Further, the study analyzes the status of regulatory legislation for new growth industries and seeks a scheme for improving regulatory legislation.
○ In Chapter Ⅳ, the study analyzes Japan’s new growth strategy and regulatory legislation; and Germany’s new growth strategy called “Industry 4.0 Strategy” and regulatory legislation.
○ Japan and Germany were selected for analysis because, with economic structure similar to Korea, they have preemptively responded to the Fourth Industrial Revolution. They aim to enhance their national competitiveness amid domestic and international changes, resulting from an accelerating trend of low growth and intensifying global competition.
□ Part 2 is entitled “Improvement of the Regulatory System and Regulatory Governance Following the Fourth Industrial Revolution - an Approach Focusing on Theories on Administrative Law.” This part of the study reviews issues arising from administrative law in developing and applying new technologies following the Fourth Industrial Revolution, including legislation, administrative action, administrative guidance, and administrative organization; and discusses legislation necessary for shifting from vertical governance to horizontal governance.
○ The study looks into the constitutional basis for the system to regulate the Fourth Industrial Revolution and proposes a scheme to improve the regulatory system in the era of Fourth Industrial Revolution with a focus on negative regulation, regulationfree zones, regulatory sandbox, no-action letter, RegTech, and self-regulation.
○ The study proposes a scheme to improve administrative legislation appropriate for the era of the Fourth Industrial Revolution by reviewing the principle of reservation of law, statutory orders, and administrative rules, It then proposes a scheme to improve administrative action and legislation for reporting, befitting the era of the Fourth Industrial Revolution. The scheme requires to look into the possibility of improving regulation by transforming conventional administrative actions; and the possibility of reviewing and utilizing reporting systems.
○ The study proposes a scheme to improve administrative contract law, focusing on regulatory contracts, contracting system for technological innovation, and innovationfriendly contracting methods; and presents a scheme to improve administrative procedure law to make it suitable for the era of the Fourth Industrial Revolution, such as public hearings, preliminary notice of administrative legislation, and procedural control of administrative plans.
○ The study proposes a scheme to improve administrative organization law to make it suitable for the era of the Fourth Industrial Revolution, focusing on the coordination of authority among administrative agencies, allocation of authority between the central government and local governments, and performance of administrative work by private persons.
○ The study proposes a scheme to improve legislation for protecting personal information in the era of the Fourth Industrial Revolution by analyzing current issues on such legislation; and presents a scheme to protect personal information in the electronic government.
○ The study proposes a scheme to improve relevant legislation through reviewing basic administrative statutes, statutes on technology related to the Fourth Industrial Revolution, and recently proposed bills regarding the Fourth Industrial Revolution.
□ Part 3, “a Study on Improvement of the Regulatory System in the ICT-Converged Industries”, proposes a scheme to improve regulatory system in the ICT convergence industry, focusing on the “prompt processing and temporary permission system”, which has been adopted in the Special Act on Promotion of Information and Communications Technology, Vitalization of Convergence Thereof, Etc.; and the “compliance certification system”, which has been adopted in the Industrial Convergence Promotion Act.
○ The study focuses on the “Innovation Pathway” of the U.S. Food and Drug Administration (FDA) and the “compliance certification system” under the Industrial Convergence Promotion Act.
○ The study proposes a policy by analyzing the “prompt processing and temporary permission system” under the Special Act on ICT; and by dividing it into a scheme to improve the regulatory improvement system and a policy scheme to invigorate the system.
□ Part 4, “a Case Study on Regulation in the ICT Convergence Industry”, searches out cases of regulation on the ICT convergency industry, such as “artificial intelligence (AI), wearable devices, and autonomous vehicles”, and presents a reasonable alternative.
○ The study demonstrates cases of regulating ICT convergence and proposes improvement methods in five major industries: autonomous vehicles, medical industry, finance industry, wearable devices, and artificial intelligence and contents industry. Based on the status of ICT convergence in domestic industries and the pledges made by the Moon Jae-in Administration regarding new industries for the future, these industries are selected from among industries converging with ICT, which do not fall under any exclusive responsibility of existing government ICT departments. Rather, they extend over tasks and fields of multiple departments and thus their boundaries are diluted by the convergence of such tasks and fields.
□ The 2017 Study for Improving Regulatory Legislation on New Growth Industries(I) has been carried out by seeking advice from experts in theories and practices regarding science, technology, and economy; and by holding experts’ meetings, symposiums, conferences, workshops, etc. for interdisciplinary study on convergence among industries, academia, and research institutes, in order to improve the quality of the study on convergence and to promote sharing and disseminating experiences in research and achievements.
Ⅲ. Expected Effects
□ A regulatory basis will be provided to support prompt industrialization and commercialization of innovative technologies in new growth industries, thereby facilitating a leap toward a global technology powerhouse.
□ This study will contribute to formulating a scheme to improve the regulatory system and the regulatory governance through reviewing the theoretical system of administrative law in the era of the Fourth Industrial Revolution.
□ This study will contribute to formulating a scheme to improve policies and legislation on the “prompt processing and temporary permission” system under the Special Act on ICT.
□ This study will contribute to formulating a desirable scheme to improve regulatory legislation by searching out cases of regulation on new growth industries and presenting an alternative for regulation.
