Relaciones entre el servicio educativo y el estatuto del consumidor (Relations between the educational service and consumer statute)

Resumen

Este artículo especializado sobre la aplicación del derecho de consumo en la prestación del servicio educativo por parte de Instituciones de Educación Superior – (IES), tiene como propósito analizar la aplicabilidad del Estatuto del Consumidor, Ley 1480 de 2011, a dicho campo. Se trata de reunir información sobre el asunto propuesto, abarcando las relaciones entre el servicio educativo y el Estatuto del Consumidor. En primer lugar, se aborda la revisión de las disposiciones constitucionales del artículo 69, como garantía de la autonomía universitaria, y del artículo 78, en torno a la protección del consumidor al adquirir bienes y servicios, y luego se parte del deslinde aparente entre normas especiales, sobre educación superior y sobre consumo. Para concluir, se busca revisar el nivel de permeabilidad del derecho de consumo en la prestación del servicio de educación, en defensa del estudiante como usuario.

Abstract

This specialized article on the application of consumer law in the provision of educational services by Higher Education Institutions Article - (IES, by its name in spanish), aims to analyze the applicability of the statute of Consumer Law 1480 of 2011, to the field. It is about gathering information on the proposed issue, encompassing the relations between the educational service and the Consumer Statute. First, the revision of the constitutional provisions of Article 69 are addressed, as a guarantee of university autonomy, and Article 78, regarding consumer protection when buying goods and services, and then part of the apparent boundary addresses between special standards, on higher education and consumption. To conclude, it seeks to check the level of permeability of consumer law in the service of education, in defense of the student as a user.
