문화적 다양성 및 혼종성이 점차 심화하고, 민족성, 종교, 인종, 언어 등 개별 특수한 정체성 간의 긴장과 갈등이 고조되고 있는 오늘날의 현실은 세계사회와 다문화사회에 대한 법철학적・법사회학적 고찰을 진지하게 요청하고 있다. 본 논문은 다문화주의와 정체성 정치에 대한 세일라 벤하비브(Seyla Benhabib)의 문화 이론이 21세기 이래 펼쳐진 다문화주의 이론과 실천 간의 간극을 메우고 바람직한 정책 방향성을 제시하는 데 여전히 유효할 뿐만 아니라 중요한 이론적 기초가 될 것이라는 전제에서, 그녀의 다문화주의 구상에 대한 기초법적 연구를 수행하고자 한다.
벤하비브는 먼저 문화를 명확하게 경계 지어진 한정된 총체로 바라보는 기존 다문화주의자들의 관점을 비판하면서, 문화의 본질적 속성에 대한 이해가 올바르게 정립되어야 한다고 주장한다. 그녀는 인간의 다양성을 지향하면서도 집단 간 차별 등 부정의를 바로잡는 대안적 방안을 모색하면서, 문화가 자신의 대화성, 내러티브성, 그리고 경쟁적 논쟁으로 인해 내적으로 갈라지게 되며, ‘우리’와 ‘그들’ 간의 경계를 계속해서 형성하고, 재구성하고, 재협상하게 된다는 변증적인 문화 이해를 제시한다. 또한 벤하비브는 유럽 및 북미와 같은 서구사회에서 펼쳐지는 일련의 문화 주장들을 분석하면서, 공식적인 제도뿐만 아니라 시민사회의 비공식적 사회운동 등을 통해 최대한의 문화적 경쟁이 이루어지는 숙의 민주적 모델을 제안한다. 이를 통해, 헌법적・법적 보편주의를 옹호하는 자유주의적 입장을 취하면서도 정치공동체에서 다문화적 갈등 및 충돌 상황을 해결하기 위한 방안을 마련하고자 했다.
본 논문은 먼저 다문화사회에 대한 벤하비브의 진단을 살펴보고, 그녀의 다문화주의 구상에 있어서 이론적 기초라고 할 수 있는 비본질주의적 문화 개념과 정체성의 내러티브 모델을 검토하도록 한다. 다음으로 보편주의와 다원주의 및 문화적 다양성의 양립가능성을 설득적으로 논증하고자 하는 벤하비브의 숙의 민주적 모델을 분석한 후, 다문화사회에서 세계사회로 연장・확장되는 거시적 지평에서 그 의의를 평가하면서 논의를 맺는다.
The increasing depth of cultural diversity and hybridity, coupled with heightened tensions and conflicts between individual identities based on nationality, religion, race, and language, necessitates a rigorous legal theoretical examination of multicultural societies. This paper seeks to perform a legal-philosophical study on Seyla Benhabib’s cultural theory of multiculturalism and identity politics under the premise that it not only remains relevant but also serves as a crucial theoretical foundation in bridging the gap between the theories and practices of multiculturalism that have unfolded since the 21st century, and in presenting desirable policy directions. Benhabib begins by criticizing the prevailing perspective shared by many multicultural theorists, which perceives culture as a clearly delineated and bounded entity, asserting that a correct understanding of the inherent nature of culture must be established. She presents a non-essentialist cultural concept and a narrative model of identity, offering a dialectical cultural understanding that continues to shape, reconstruct, and renegotiate boundaries between ‘us’ and ‘them.’ Additionally, Benhabib aims to devise a deliberative democratic model where the maximum level of cultural competition takes place in formal public discourse and through civil society movements and institutions, analyzing a series of cultural and political claims that emerge within Western societies such as Europe and North America. Through this, she intends to provide avenues for resolving multicultural conflicts and clashes within political communities while concurring with the liberal stance that constitutional and legal universalism must be maintained.
