보조생식술의 이용은 가족생활에 대한 헌법적 보장 그리고 구성원의 탄생을 통한 사회 유지와 직결되어 있는 문제이면서, 부모가 되고자 하는 자 외에 제3자(생식세포 기증자 및 대리모)의 개입, 체외에 존재하게 되는 생식세포와 배아의 관리 및 사용 등과 관련하여 복잡한 윤리적 법적 쟁점을 담고 있는 문제이다. 이에 보조생식술의 이용은 이제 개인의 문제가 아닌 사회적 국가적 차원의 문제로서 보다 적극적으로 지원ㆍ감독될 수 있어야 할 뿐만 아니라 필요한 경우 규제될 수 있어야 한다. 물론 이러한 규제와 지원ㆍ감독을 위해서는 법적 제도적 뒷받침이 있어야 할 것이다. 이에 이 글에서는 보조생식술과 관련하여 그간 제안되었던 법률안의 조항들을 참고로 하여 실제 입법 시 어떠한 내용들이 필요하고 고려되어야 할 것인지를 살펴봄으로써, 난임 해결을 위한 보조생식술의 이용이 오ㆍ남용의 문제를 발생시키지 않도록 관리될 수 있도록 하면서도 필요한 부분에 대해서는 명확한 법적 근거를 바탕으로 충분히 지원될 수 있도록 함으로써 현재 윤리적으로나 법적으로 당면하고 있는 복잡한 문제들이나 혼란 발생 가능성에 대해 적절히 대처 가능할 수 있도록 하기 위한 방안을 모색해보고자 한다.

To use the Assisted Reproductive Technology(hereinafter referred to as "ART") is related to the guarantee of family life under the constitutional law and the maintenance of the society by the birth of the members, so it is very meaningful both the individual and society. But it has so many and serious ethical and legal issues because the third parties such as the gamete donor and surrogate mother can be involved in the use of the ART and the human gametes and embryos that have to be treated in vitro should be managed. Therefore, the ethical and legal issues related to use the ART is no longer the matter of individual level. These issues have to be considered under the social dimension. Also, to use the ART has to be publicly regulated under the law, to be supported by the functional system, to be overseen by the supervisory authority. For this, it is imperative to lay the legal groundwork for the public regulation as well as to prepare and provide the institutional strategy to support and to oversee the use of the ART. In This article, referring to the legislative bills that were proposed and reviewed in National Assembly, I take the important consideration to make the provisions for the public regulation and to find the essential needs to draw up the ART supporting system and the ART supervisory authority. The ethical and legal problems are already happening. So, to find the way to prevent the ART abuse and to support the appropriate use of the ART is an urgent task that cannot be delayed any longer. To prevent the ART abuse and to support the appropriate use of the ART will be able to be realized on the obvious legal basis and under the functional supporting system with the supervisory authority.
