»Zum Schutze der Geistesschöpfungen auf der ganzen Welt« Die Geschichte der internationalen Verrechtlichung des Autorenschutzes 1850–1952

The article looks into the internationalization of authors' rights from a historical perspective. Since the end of the 19th century the emergence of international copyright agreements has been closely interconnected with the foundation of specialized international organisations which were entrusted with the implementation and revision of the underlying multilateral treaties. The article analyzes the impact of these organizations on the process of internationalization. It is argued that the international organizations opened up new possibilities to authors and publishers to actively contribute to the drafting of international copyright norms. Furthermore, the examples of the 'Berne Union for the Protection of Literary and Artistic Property' and the 'Intellectual Co-operation Organization' of the League of Nations show that the organizations' bureaucratic structures and procedures opened up new perspectives for actions of the international civil servants in order to influence political decisions on the future of multilateral copyright conventions. Der Aufsatz widmet sich der internationalen Verrechtlichung des Autorenschutzes von der Mitte des 19. bis zur Mitte des 20. Jahrhunderts. Im Zentrum steht die rechtsgeschichtlich bisher nur wenig beachtete Verknüpfung der Institutionalisierung und Weiterentwicklung multilateraler Standards zum Schutz von Autoren und Verwertern mit der Gründung internationaler Organisationen, deren Funktion vor allem darin bestand und besteht, die Abkommen zu betreuen, zu verstetigen und ihre Anpassung an technische und gesellschaftliche Entwicklungen zu betreiben. Es wird gezeigt, dass die internationalen Organisationen jedoch nicht nur administrative Aufgaben erfüllten. Vielmehr entstand mit ihrer Einrichtung ein institutioneller Ort, der es Akteuren aus Kultur und Gesellschaft ermöglichte, an dem Prozess der Internationalisierung von Urheberrechten aktiv zu partizipieren, und der zugleich dem Personal der internationalen Organisationen Handlungsspielräume eröffnete, um inhaltlich Einfluss zu nehmen. Anhand der Berner Union für den Schutz des literarischen und künstlerischen Eigentums und der Organisation für geistige Zusammenarbeit des Völkerbundes wird die Geschichte der internationalen Verrechtlichung des Autorenschutzes bis zur Mitte des 20. Jahrhunderts aus akteurs- und organisationsgeschichtlicher Perspektive als eine Geschichte der sukzessiven »Vergesellschaftung« des internationalen Autorenschutzes analysiert.
