Abstract
So-called ‘best endeavours’ clauses, which are generally known in the United States as ‘efforts’ clauses, are very popular in Commercial Agreements in general and also in Sports Marketing Agreements in particular. However, they are problematic, in practice, and should be used with care and circumspection. They should always be mutual and never unilateral.
