Zusammenfassung
Vor einer diagnostischen Maßnahme oder einer Operation muss der Patient über die Dringlichkeit der Maßnahme aufgeklärt werden. Daher unterliegt dem Arzt die Beweislast, dass eine vollständige und richtige Aufklärung erfolgt ist (BGH, Urteil vom 26.06.1990, VI ZR 289/89, und BGH-Urteil vom 07.11.2006, VI ZR 206/05).
