Zusammenfassung
Eine Definition des Begriffs „Minderheit“ wird seit Jahrzehnten in der völkerrechtlichen Literatur und Praxis erfolglos versucht. Hier soll lediglich das Verständnis des Begriffs „nationale Minderheit“ innerhalb der OSZE unter Rückgriff auf seine Bedeutung in anderen internationalen Verträgen und Dokumenten untersucht werden.

Als Beispiel werden die dänische Minderheit im südlichen Schleswig und die deutsche Minderheit im nördlichen Schleswig genannt. Beide haben dieselbe ethnische Herkunft, der Minderheitenstatus leite sich von der dänischen bzw. deutschen Mentalität ab. M. E. ist dies nicht überzeugend, da diese Minderheiten als sprachliche oder kulturelle Minderheiten bezeichnet werden können. Insoweit ist die anderslautende Interpretation von Art. 27 IPBürgR durch den General Comment Nr. 23 (50) des Menschenrechtsausschusses zu Art. 27 vom 26.4.1994 (CCPR/C/21/Rev.1/Add. 5 para. 5.1 und 5.2), die auch Ausländer in den Schutz einbezieht, unbeachtlich. Die Schutzberechtigten können nämlich auf UN-und regionaler Ebene unterschiedlich definiert sein. Einen Grund könnte dies in der unterschiedlichen Reichweite der Rechte haben: Auf UN-Ebene ist sie gering, so kann die Berechtigung weit ausgelegt werden. Auf europäischer Ebene — OSZE, Europarat — gehen die Rechte viel weiter, so daß die Berechtigung beschränkter ist.
