Zusammenfassung

Die Freiheiten des Denkens und der Rede sind zentrale Prinzipien liberaler, demokratischer Gesellschaften. Sie werden in internationalen Deklarationen als Menschenrechte garantiert und sind in vielen Ländern konstitutionell verankert (vgl. Art. 18 bzw. 19 AEMR; Art. 9 bzw. 10 EMRK; Art. 4 bzw. 5 GG; Erster Zusatzartikel der US-Verfassung). Den kognitiven und kommunikativen Freiheiten kommt eine doppelte Bedeutung zu: Zum einen handelt es sich um klassische Abwehrrechte, die das Individuum in seiner persönlichen Entfaltung vor staatlichen Eingriffen schützen.
