Abstract

Uruguayan courts have successfully applied the New York Convention, and its text and spirit have been respected in all Supreme Court judgments. In this respect, Uruguay has followed its tradition of “pro-recognition and enforcement” of foreign awards. However, only six cases dealing with the recognition and enforcement of foreign awards have been decided since the Convention entered into force. This is likely due to the small number of international arbitrations involving Uruguayan parties or foreign companies with assets in Uruguay. As a result, the Convention’s application has not given rise to noteworthy difficulties problems and the Convention itself has not been the object of much criticism.
