Abstract

On 21 April 2004, Directive 2004/35/CE on Environmental Liability with Regard to the Prevention and Remedying of Environmental Damage (hereafter Directive or ELD) was adopted.1 According to Art. 19 of the Directive, Member States have until 30 April 2007 to transpose the Directive into national law.
