Abstract

Legal control of infertility has privileged traditional family formations, constraining the reconstruction of motherhood. Regional variation in NHS-funded assisted reproductive technologies (ART) reflects this, with government support for social determinations of IVF access made by Clinical Commissioning Groups (CCGs). Compared to steadfast age restrictions, a marginal rise in access rates for same sex couples reveals the bargaining chip of legal action for patients. This is limited to individual cases, however, with the community yet unable to fully capitalise on a wider paradigm shift around same sex marriage, and establish habitual patterns of successful interaction to inform the policy process. Despite COVID-19 regulations extending the statutory storage limit for frozen eggs, sperms and embryos, treatment delays are set to further exacerbate barriers for these intersections.
