지방분권체제에 있어서 문화국가원리의 의미

문화국가원리는 대중의 문화 창달을 촉진하고, 국민의 기본권보장을 강화하며, 국민의 민주주의 역량을 제고한다. 지방분권실현을 통한 문화국가원리는 지방의 지방문화 창달역량을 높여 주민복지를 강화할 수 있으며, 지방과 중앙간의 실질적 균형발전을 도모할 수 있을 뿐만 아니라, 지방과 중앙간의 실질적 권력분립을 완성할 수 있고, 나아가 대중의 민주주의역량도 강화할 수 있다. 그리고 문화국가원리는 현대국가의 정치원리인 평화국가·민주국가·복지국가 이념과도 내적 통일성을 가지고 있음으로 문화국가원리를 실질적으로 구현할 수 있는 지방분권체제에서 민주주의와 복지국가 이념도도 보다 실질화 할 수 있다. 따라서 지방분권 강화를 통한 실질적인 지방자치제는 문화국가원리 뿐만 아니라 다른 제헌법원리도 실질화 할 수 있음에 비추어 보아 지방분권의 강화의 필요성은 아무리 강조해도 지나치지 않는다. 따라서 지방분권 강화를 위한 헌법개정을 통해 기존의 중앙정부가 가지고 있던 권한을 실질적으로 지방정부에 이양하면 지방정부가 보다 많은 권한과 책임을 가지고 지방문화를 창달할 수 있어 문화국가원리는 보다 실질적으로 구현될 수 있다. 문화국가원리는 문화를 창달하고, 인간의 존엄과 가치를 실현하며, 민주주의 이념을 보완하는 기능을 가지고 있다. 또한 문화국가원리는 반전체주의적 평화국가원리와 문화복지를 통한 복지국가원리 그리고 문화다원주의에 입각한 민주국가원리를 함의하고 있다. 따라서 문화국가원리는 지방분권실현을 통하여 지방문화 창달을 통한 민족문화창달 역량을 제고하고 주민복지를 강화하며, 지방문화 창달로 지방과 중앙간의 실질적 균형발전을 도모하고 실질적 권력분립을 정착할 수 있으며, 또한 주민의 민주주의 역량을 강화할 수 있다. 이러한 점에서 실질적 지방분권을 위한 제도적 기반으로서 지방분권 개헌논의는 문화국가원리의 핵심적 과제라고 하지 않을 수 없다.

The modern nation adopts the principle of cultural state to achieve democracy ideals by adopting the culturalism ideals and strengthening the popular democracy ideals and guaranteeing the cultural fundamental rights of the people as one of the main political principles. Therefore, the principle of the cultural state promotes the promotion of the culture of the masses, strengthens the basic rights of the people, and raises the democratic capacity of the people. And it can be understood that the principle of cultural state has internal unity with the ideology of peace state, democratic state and welfare state which is the political principle of modern nation. The principle of cultural state through the realization of decentralization can enhance local welfare of local residents by enhancing the capacity of locality to cultivate local culture. It can not only promote the real balanced development between the provinces and the central region, And can further strengthen the democratic capacity of the public. Therefore, it can not be overemphasized to emphasize the necessity of strengthening decentralization in light of the fact that the actual local self-government through the strengthening of decentralization can materialize not only the cultural state principle but also other constitutional principles. Cultural state principle has the function of cultivating culture, realizing human dignity and value, and complementing democratic ideology. The principle of cultural state implies democratic principle based on anti-totalitarian peace state principle, welfare state principle through cultural welfare and cultural pluralism. Therefore, the principle of cultural state is to promote local culture through the realization of local decentralization. Also It is possible to promote a balanced development between the provinces and the central region through the promotion of local culture, to establish the real division of power, and to strengthen the democratic capacity of the residents. In this respect, discussions on amendment of decentralization as an institutional basis for practical decentralization can not but be a core task of the cultural state principle.
