본 연구에서는 데이터기반의료에 있어서 의료수준의 규범화에 대한 새로운 법적 문제를 다루고 있다. 디지털의료정보의 수집은 한편으로는 기술적인 지원 없이는 더 이상 할 수 없고 다른 한편으로는 이러한 정보들을 통해 맞춤의학을 원하는 환자에게 개별적인 진료를 할 수 있는 기초를 제공할 수 있다. 이러한 점에서 보건영역에서 이러한 정보의 가공과 평가는 보건시스템에 중요한 영향을 줄 수 있다. 앞으로는 스마트폰 등을 이용한 정보의 수집이 의료수준이 될 수 있고 이는 현대의학에서 새로운 전기를 마련할 것이다. 이러한 새로운 의료시스템은 많은 변화를 가져올 수 있는데 환자에게는 민사책임에서 의료수준의 개념에 대한 문제가 제기될 수 있다. 이러한 의료시스템의 시행을 위해서는 구체적인 법적 요건들을 충족해야 한다. 다음에서는 디지털화에 따른 의료의 기술적인 발전에 대해서 설명하고(II), 데이터기반의료에서 의료수준에 대한 개념을 통해 법적 및 실무적인 문제들을 자세히 검토하고 있다. 아울러 법적인 측면에서 데이터기반의료에 대한 책임에 어떠한 영향을 주는지에 대해 제시하고 있다(III). 마지막으로 이러한 시스템의학의 가능성과 위험에 대한 평가와 새로운 문제들에 대한 전망을 제시하고 있다(IV).

The study presents new legal challenges for creating a clear concept of standardization of data-based medicine. On one hand, not only enormous data storage and management solution but also advanced technical support are required to record and store health data in digital form and to process. On the other hand, the stored medical data may provide critical medical infornation for treating individuals who look forpersonalized medicine for them. It is clear that the way of processing and using medical data would shape the structures of the health care market. In the future, the collection of data with the smartphone or wearables devices will be very common. Information and technology (IT) advances will create new phenomenon and then will bring great changes in the medical sector. Future changes would presents new challenges to patients as well as healthcare professionals. To prepare changes and challenges of a new personalized health care system, certain legal prerequisites must be fulfilled. Then the study discusses technical developments in medicine brought by the degitalization (II). The legal and practical problems regarding conceptualization of medical standards in data-based medicine are examined in detail. Next, the legal implications of liability for data-based medicine are explored (III). Lastly, the study assesses a political outlook on the new challenges and the assessment of opportunities and risks in system medicine (IV).
