지경학의 연결성으로서 한일대륙붕공동개발협정: Post-2028년을 대비하는 한일 양국의 입장과 중국 변수

본 연구는 post-2028년을 대비하여 한일대륙붕공동개발협정을 둘러싼 한일 양국의 입장과 중국 변수가 어떻게 작용할 것인지를 조명하는 것이다. 논의는 post-2028년의 한일대륙붕공동개발협정이 어떠한 형태로 존속될 것인지에 대한 물음으로부터 시작된다. 이는 새로운 한일관계 정상화를 위해 타개해야 할 긴급현안으로 부상하고 있다. 2028년 한일대륙붕공동개발협정이 종료되면, 현재의 한일공동개발구역(JDZ)은 한·중·일 3국의 각축장으로 변할 것이다. 무엇보다도 중국은 JDZ의 일부 수역에 관해 관할권을 주장하고 있어, 협정 종료 이후 새로운 대륙붕 경계를 확정하는 데 적극적으로 개입해서 현상 변경을 시도할 것으로 예상된다. 이러한 문제 인식하에 한일대륙붕공동개발협정의 이행 및 지속 방안은 지경학의 연결성이란 관점에서 UN해양법 협약의 일반원칙 및 규범, 중일공동개발구역, 에너지 안보확보･기후변화 대응 등을 고려하여 신협정의 체결을 대안으로 제시한다. 신협정은 2028년 이후에도 동 협정의 효력을 유지하고, 실질적으로 대륙붕 탐사･개발이 가능한 공동개발구역의 조정, 이행을 위한 공동기구의 설립과 함께 안정적인 대륙붕 공동개발협력체제를 수립하는 것이다. 따라서 post-2028년을 직면한 한국으로서는 일본의 비협조적인 태도를 명확하게 인식하고 JDZ의 한일대륙붕공동개발협정의 실질적인 이행과 지속 방안을 위해 현실적인 대응 전략을 수립해야 할 것이다.

This study sheds light on how China factor will work and the positions of Korea and Japan regarding Korea-Japan Agreement concerning Joint Development Agreement of the Continental Shelf in preparation for post-2028. The discussion begins with the question of how Korea-Japan Agreement concerning Joint Development Agreement of the Continental Shelf from post-2028 will continue. There is emerging as an urgent issue that needs to be overcome for the normalization of new Korea-Japan relations. If Korea-Japan Agreement concerning Joint Development Agreement of the Continental Shelf ends in 2028, the current Korea-Japan Development Zone (JDZ) will be transformed into battleground among Korea, Japan and China. As China claims jurisdiction over some waters in the JDZ, it is expected that China will actively intervene in determining the boundaries of the new continental shelf after the end of the agreement and attempt to change the status quo. Recognizing this problem, the implementation and continuation of Korea-Japan Agreement concerning Joint Development Agreement of the Continental Shelf proposed the conclusion of a new agreement as an alternative, considering the general principles and norms of the United Nations Convention on the Law of the Sea, the Sino-Japanese Joint Development Zone, securing energy security and responding to climate change from the viewpoint of geoeconomic connectivity. The new agreement will maintain the validity of the agreement even after 2028 and establish a stable continental shelf joint development cooperation system with establishment of a joint organization for coordination and implementation of joint development zones that can be practically explored and developed on the continental shelf. Therefore, as Korea faces post-2028, it is necessary to clearly recognize Japan’s non-cooperative attitude and establish a realistic response strategy for the practical implementation and continuation of Korea-Japan Agreement concerning Joint Development Agreement of the Continental Shelf in the JDZ.
