Zusammenfassung

Das Gesetz in § 106 Abs. 5d Sozialgesetzbuch V sieht seit einiger Zeit verschiedene Möglichkeiten vor, die unliebsamen Richtgrößenprüfverfahren auf einvernehmlichem Wege zu beenden. Es kommt nicht wie sonst zur Festsetzung eines Regresses durch die Prüfungsstelle oder den Beschwerdeausschuss, sondern zwischen Arzt und Prüfgremium wird eine Art Vertrag geschlossen, der das Prüfverfahren abschließt. Insgesamt stellen sich die individuelle Richtgrößenvereinbarung und der Vergleichsabschluss damit als durchaus interessante Handlungsmöglichkeiten dar.

Abstract

The law in § 106 paragraph 5d of the Code of Civil Law provides for various possibilities for a mutual agreement to terminate the unpleasant benchmark checking procedure of prescriptions. This does not as otherwise lead to establishing a regress by the testing body or the complaints committee but a form of contract is sealed between the physician and the test panel, which then finalizes the test procedure. Overall the individual benchmark agreement and the compromise settlement represent interesting options for bargaining.
